These User Terms of Service (“Terms”) govern your use of your own personal Maptionnaire user account (“Maptionnaire Account”).
By creating a Maptionnaire Account, you accept these Terms and will enter into a binding agreement with Mapita Oy (Business ID: 2399273-5) (“we” or “Mapita”).
In order to create a Maptionnaire account you must be at least 16 years old.

1. How Maptionnaire Works
Maptionnaire is a SaaS-based community engagement platform, through which various organizations (“Organizations”) can create map-based surveys for gathering resident feedback and ensuring a smoother public participation process.
Maptionnaire also enables individuals (“Users” or “you”) to create personal user accounts in order to track and review the surveys responses they have previously provided to Organizations via the Maptionnaire platform (“User Content”).
Creating and using a Maptionnaire account is free of charge.
2. Using the Maptionnaire User Platform
Subject to your compliance with these Terms, you have a limited, non-exclusive, non-transferable, and non-sublicensable right to create, access and use your personal Maptionnaire Account.
All Maptionnaire Accounts are strictly personal. You are responsible for keeping your user credentials and password confidential.
Please note that the Maptionnaire user platform is provided to you in the form available from time to time. We are continuously developing and thus may make modifications or changes to the platform at our sole discretion.
3. Restrictions of Use
You may use Maptionnaire only in accordance with these Terms and only for the purposes set out herein.
Unless otherwise permitted, you may not:
a) circumvent or attempt to circumvent any usage control or anti-copy features within the Maptionnaire platform;
b) reverse engineer, decompile, disassemble or otherwise attempt to derive the source code of the Maptionnaire platform or any related technology, or any part thereof;
c) use the Maptionnaire platform in violation of applicable laws;
d) use the Maptionnaire platform in ways that violate intellectual property rights, trade secrets or privacy of Maptionnaire or any third parties;
e) use the Maptionnaire platform for unauthorized, inappropriate or unethical purposes or activities; or
f) use the Maptionnaire platform to transmit any material that contains malware, spyware, software viruses, worms or any other computer code designed to interrupt, destroy, or limit the functionality of computer software or equipment.
4. Third-party Services and Content
Certain functionalities, interfaces and content within the Maptionnaire platform may be provided by third parties.
Please note that these Terms cover exclusively the Maptionnaire platform and the use thereof. Any and all linked third-party services, interfaces and content are provided by the relevant third parties and covered by their terms of service or other agreements or licenses. We do not assume any liability in regard to use of such third-party services and content, whether or not they are referenced by or available within the Maptionnaire platform.
5. Intellectual Property Rights
All intellectual property rights in or related to the Maptionnaire platform and all parts and copies thereof shall remain exclusively vested with and be the sole and exclusive property of Mapita.
Except as expressly stated herein, these Terms do not grant you any intellectual property rights in the Maptionnaire platform. All rights not expressly granted hereunder are reserved by us and our subcontractors or licensors, as the case may be.
6. No warranty; Liability
We try to keep Maptionnaire up and running. Please however note that the Maptionnaire platform may at any time be temporarily interrupted or permanently discontinued and may contain errors and inaccuracies. We are not responsible for any damages caused by such interruptions, suspensions, errors or inaccuracies or from any use of the Maptionnaire platform by you.
Maptionnaire is provided “as is” and with the functionalities available at each time without warranty of any kind, either express or implied.
This section does not limit our statutory liability for defects to our consumer Users or your statutory remedies under any applicable mandatory consumer protection laws.
7. Privacy and Data
We may collect, generate, process and store data in relation to your Maptionnaire account and your use of the Maptionnaire platform, such as your Maptionnaire account profile data, credentials and data relating to your use of the Maptionnaire platform.

Please however note that in regard to any personal data you submit as part of your responses to surveys or questionnaires, the data controller is the Organization that has initiated the questionnaire.
8. Amendments
We may amend these Terms by publishing the amended Terms on our website. By continuing to use Maptionnaire after the amendments have been published, you accept the new Terms.
9. Assignment
Maptionnaire has the right to transfer and assign Maptionnaire’s rights under these Terms (including intellectual property rights and licenses) to our affiliates or as part of a sale or transfer of our business or other corporate acquisition.
10. Applicable law and Dispute resolution
These Terms shall be governed by and construed in accordance with the laws of Finland, notwithstanding its choice of law provisions. If you are a resident in a country other than Finland, there may be mandatory consumer protection laws which give you rights in addition to those in these Terms and in Finnish consumer protection legislation.
Any dispute arising from or relating to these Terms shall be settled by the District Court of Helsinki as the first instance. However, Finnish consumers may initiate proceedings in the court of their domicile. If you are a resident in a country other than Finland, mandatory consumer protection laws of that country may provide a mandatory forum for settlement of consumer disputes.
As a consumer residing in the European Union you may also refer a dispute to online dispute resolution provided by the European Commission (please see ec.europa.eu/odr). Finnish consumers may refer a dispute to the Finnish Consumer Disputes Board (please see kuluttajariita.fi).
